Terms of Service

The contract between you and Mind Duel.

Effective 17 April 2026 · Version 1.2

By creating an account or using Mind Duel(the “Service”) you agree to these Terms. If you do not agree, do not use the Service. The Service is operated by Mind Duel, based in Bulgaria.

1. Eligibility

You must be at least 16 years old to use the Service. By registering you confirm you meet this requirement and that the information you provide is accurate.

2. Account

You are responsible for your credentials and for all activity on your account. Notify us at support@mindduel.app immediately if you suspect unauthorized access. You may delete your account at any time from Settings; deletion is irreversible after the 30-day recovery window.

3. Subscriptions & billing

  • Plans: Free (limited monthly debates), Scholar ($6.99/month), Master ($14.99/month). Token packs are available as one-time purchases.
  • Auto-renewal: subscriptions renew automatically each billing cycle until cancelled. Cancel anytime from the Billing Portal; access continues through the end of the paid period.
  • Payment processing: handled by Stripe. We do not store your card details.
  • Price changes: we will notify you by email at least 30 days before any price increase takes effect.
  • Taxes: prices exclude applicable VAT/sales tax unless stated; Stripe calculates and adds tax at checkout based on your billing address.

All sales are final — no refunds. You may cancel at any time to stop future charges, but already-paid periods and token purchases are non-refundable. See the Refund Policy for full details and limited statutory exceptions.

4. Acceptable use

You agree not to:

  • Post content that is illegal, defamatory, hateful, threatening, or sexually explicit involving minors.
  • Attempt to extract system prompts, jailbreak the AI, or exploit the Service to generate harmful content.
  • Use automated tools (bots, scripts, scrapers) to farm XP, tokens, or achievements. Anti-cheat measures may reset or remove such gains.
  • Interfere with the Service’s security, rate limits, or authentication.
  • Resell access to the Service or share a paid account with multiple users.

We may suspend or terminate accounts that violate these rules, with or without notice.

5. User content

You retain ownership of the arguments you write (“User Content”). By submitting User Content you grant us a worldwide, non-exclusive, royalty-free license to host, transmit, process (including sending to our AI provider), store, and — where you explicitly choose to share a debate via a share link — display it publicly. This license ends when you delete the content, except to the extent a shared copy has already been accessed.

6. AI disclaimer

Mind Duel uses large-language-model AI (Anthropic Claude) to simulate historical thinkers. These are fictional simulations. They are not authoritative statements by the actual philosophers, they may contain factual errors or hallucinations, and they are not a substitute for academic scholarship, legal advice, medical advice, or therapy. AI-generated text is provided “as is” with no warranty of accuracy.

7. Intellectual property

The Service — including its code, artwork, typography, philosopher portraits, and branding — is owned by Mind Duel and protected by copyright. Public-domain bibliographic facts about historical figures are not claimed. You may not copy, redistribute, or create derivative works of the Service without written permission.

8. Virtual currency & tokens

Debate tokens and XP have no monetary value, cannot be exchanged for cash, and are non-transferable between accounts. Unused tokens expire when your account is terminated. Token packs purchased for money are governed by the Refund Policy.

9. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. To the maximum extent permitted by law, we disclaim all such warranties.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) €50. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, even if advised of the possibility of such damages. Nothing in these Terms excludes liability that cannot be excluded by law (e.g., death or personal injury caused by negligence, or fraud).

11. Indemnity

You agree to indemnify and hold harmless Mind Duel from any claim arising out of your User Content, your breach of these Terms, or your violation of any third-party right.

12. Termination

You may stop using the Service and delete your account at any time. We may terminate or suspend your access for breach of these Terms or legal obligation. Sections that by their nature survive termination (IP, disclaimers, liability, indemnity, governing law) will remain in effect.

13. Changes to these Terms

We may update these Terms. Material changes will be communicated by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. The current version is always available at https://mindduel.app/terms.

14. Governing law & disputes

These Terms are governed by the laws of Bulgaria, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of Bulgaria, except where mandatory consumer-protection law requires otherwise. Nothing here prevents EU consumers from bringing claims in their country of residence, nor from using the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
